§ 1
Subject of terms of use

• The regulations specify the terms of use and functioning, as well as the rights and obligations of users and the duties and responsibilities of Windu.org services, located at http://www.windu.org/ i http://www.windu.pl/

Dictionary

• CMS System" - Content management system that is affected by those terms
• Windu CMS" - Content management system that is affected by those terms
• Application" - Content management system that is affected by those terms
• Service" - website located at www.windu.org or www.windu.pl and all of its subdomains and subdirectories
• Domain" - Internet address at which the web site is

§ 3
Technical requirements

• To use the Service and Windu CMS it is necessary to have a device with access to the Internet, an application used to view the contents of the Internet
• To use the Windu CMS it is required to have Your own server or hosting account that meets the technical requirements such as:
  • Apache server
  • PHP in 5.2 version or newer
  • Support of SQLite 2 or newer
  • Support of Rewrite Module
  • Support of CURL
  User before buying a Pro or Plus license can test the system and see if the free version will run on the server or hosting account.
• User or other person visiting service is required to provide their own equipment and required software.
• The service provider shall not be liable for failing to run Windu CMS on your server. It's Users is responsibility to check whether the system works correctly on his hosting account by downloading the free version of the system. Only after making sure, that basic version of the Windu CMS system works correctly, he should purchase the extended license, that includes additional features of Windu CMS.

§ 4
Conclusion and Terminating the agreements for the provision of services

• The Agreement for the provision of Information Services is concluded at the time of entry into the browser URL of the Service and terminated at the end of browsing service website.
• The Agreement for the provision of Information Services is concluded at the start of Windu CMS system on your own server and terminated after its complete removal from the server and cessation of use by the user.

User Obligations and other person visiting service or using Windu CMS

• Service provider has the right to suspend or deny access to the Application when the User goes against the provisions of the Terms of service or his actions can jeopardize the safety of the data collected on the Site or Application or his actions threaten the good name or reputation of the Service Provider or Application.
• User to protect His interest should keep His account details a secret.
• Users visiting service are required to use the Service and Application in accordance with the law and good practice, in particular are obliged to respect the personal rights and intellectual property rights of third parties.
• User and any other person using the Windu CMS system in the free version has to place in a conspicuous place an active link to a Windu website with information that the engine or cms system website is using is Windu CMS.

§ 6
Liability of Service Provider

• The application is only support for the conduct of business by the user, and the same service provider (JCD.pl Adam Czajkowski, al.Reymonta 28/21 01-842 Warsaw, Poland) does not accept any liability associated with business ran by the User.
• Service Provider reserves, that the use of the Service is solely at the expense and risk of the person visiting it.
• ervice Provider reserves the right to compile statistics characterizing the population of users or other people visiting service for presentation to potential partners.
• The service provider shall not be liable for any damages resulting from the use or incorrect functioning of the Service or Application and improper use of the Service or Application by the User and other visitor of service, unless the damage is the result of willful misconduct of the Provider.
• The service provider shall not be liable for any damages resulting from improper functioning of the equipment or software that User and any other visitor of the Service.
• The service provider shall not be liable for any damages resulting from the disclosure of data by the User allowing third parties to access the Application.
• Service Provider does not assume any responsibility for use of the Service or Application by the User or any other person visiting service in a manner inconsistent with the provisions of the law, including in a manner inconsistent with the provisions of the Regulations.

§ 7
Paid Windu PRO and Windu PLUS licenses

• Users who purchase licenses PRO or PLUS through the service gain access to the locked part of the CMS described as available for the purchased license in the CMS system.
• Licenses Windu PRO and Windu PLUS entitle You to remove the link that indicates the websites engine.
• Licenses Windu PRO and Windu PLUS does not give the right to remove information about the authors of the system and does not give the right to make changes in graphic design of administrators panel of CMS system
• User purchasing the license key recives specified number of domains for which the license has the right to activate Windu PRO or Windu PLUS, after the activation of the CMS system for the domain system automatically removes one avaiable key, after the exhaustion of the keys it is not possible to activate another website.
• The concept of a domain is defined as a web address at which the site is, the license key will be deducted after the change of both domain and subdomain and a subdirectory within your domain.
• User can not deactivate the license key for a given domain and a one-time activation is irreversible.
• User is informed when purchasing a license key what type of license key it is and for how many domains it can be activated for.
• The service provider is not responsible for the fate of the license key, User should keep it only for themselves and should not share it with others.
• Service Provider does not guarantee the functioning of the additional items for the CMS released after the CMS license key was entred in the system, they are only an addition to the system and are not covered by any warranty just like the rest of the system.

§ 8
Protection of intellectual property rights

• The appearance and layout of the content available on the Site and Application are works within the meaning of the Act from 04 February 1994 on Copyright and Related Rights and as such benefit from the protection provided by the law.
• The protection referred to in the act. 1 also benefits all other works, trademarks, and other elements such as, among others The text, images and multimedia placed in the Service or the Application.
• Use of the Service or Application by the User or any other person visiting service does not mean They acquire any rights to intangible property to shared tracks.
• It is prohibited to copy or modify any part of the Service in whole or in part and to modify or use in a manner other than that specified in the Regulations, without the prior consent of the Service Provider, expressed in writing to be valid.
• Any fees charged by the service provider are charged only for the part of the Windu CMS system code which is the exclusive intellectual property provider of the service provider, the remainder of the code used in the application on the basis of an open source license and MIT is available free of charge under a license and the fees charged by the service provider do not apply.

§ 9
Privacy

• The service provider processes, subject to paragraph. 2, personal information of the User or any other visitor of the service only to the extent necessary to provide proper services, which includes sending the user system messages via email and information on the barriers, technical interruptions or changes in the method of operation of the Service or Application.
• In addition to the Users email address promotional materials information may be sent coming from service providers or entities working with him.
• Upon termination of the contract for the provision of Informatics Services, the Service Provider at the express request of the user deletes all the data entered in the Application during the term of the contract.
• The service provider shall take all necessary technical measures to protect the data entered into the Application.

§ 10
Privacy politics

• As part of the Services, Provider or entities authorized by him are authorized to collect and process data necessary to perform the Services, but not personal information.
• Service Provider declares that it uses cookies mechanism that by writing short text information on Users computer or any other visitor of the Service allows its identification in order to optimize the use of the Service and Application.
• Service Provider represents that it collects information about visitors of the Service or Application solely for Service Providers needs and sharing these to third parties is only possible if:
  - it is required by law;
  - To provide the Services and after obtaining the appropriate consent of User;
• ervice Provider reserves the right to compile statistics characterizing the population of users or other people visiting service for presentation to potential partners.

§ 11
Final Provisions

• Service Provider reserves the right to change the Terms and Conditions and the Price List, the price list changes do not affect the provision of services already paid for.
• The changes referred to above are valid within 7 (seven) days from the date the new version of Terms of service is released.
• Content of Terms of service is available on the Site and may at any time be saved or printed.
• Terms of service come into use on 20.12.2012
